  1. Back in December, we reported that the Cadillac ATS sedan would be no more for the 2019 model year via a General Motors VIN Decoder document. Only the coupe would stick around. Cadillac declined to comment at the time. Yesterday, new evidence to the sedan's departure came to light via GM's fleet order guide. The Truth About Cars tried to get a comment from Cadillac about this new information, but wasn't able to. That changed this morning. “This year will bring forth significant changes to our product portfolio, most notably with the introduction of the all-new XT4 SUV as well as concluding the successful lifecycle of the ATS Sedan in North America. The ATS Coupe, which is on a later lifecycle, will continue into 2019,” wrote Cadillac spokesman Donny Nordlicht in an email to The Truth About Cars.   3. In 2009, the U.S. saw its lowest number of pedestrian deaths. But since then, that number has increased by 46 percent as pedestrian crashes have become more frequent and deadlier. Why is that? The Insurance Institute for Highway Safety released a study today investigating the possible reasons. One key indicator is the number of crashes involving SUVs. According to IIHS data, between 2009 and 2016, fatal single-vehicle crashes involving SUVs rose 81 percent - the largest increase of any vehicle segment. Aside from the growing popularity of SUVs and crossovers, the tall body height and larger footprint mean in a pedestrian crash, the vehicle is hitting a person's chest or head. SUVs weren't the only metric to see an increase. IIHS reports that urban environments, arterial roads, nighttime, and non-intersection crashes have seen large increases. Can anything be done to help reduce pedestrian fatalities? According to the IIHS, there is a lot that can be done. Softening the front ends of SUVs Improving pedestrian detection systems and headlights (The latter would be helped if NHTSA can get its act together on updating their headlight regulations) Lower the speed limits Adding more "pedestrian hybrid beacons" - Kind of a sudo-stop light where a pedestrian activates it before crossing. Begins flashing yellow, before transitioning to solid yellow, and then solid double red. "Understanding where, when and how these additional pedestrian crashes are happening can point the way to solutions. This analysis tells us that improvements in road design, vehicle design and lighting and speed limit enforcement all have a role to play in addressing the issue," said IIHS President David Harkey. This type of deal is very unusual and it was speculated that U.S. wasn't planning to charge Diess over the diesel emission scandal, or that he provided some sort of testimony. We might have an answer to how Diess got this deal. German tabloid Bild reports that Diess traveled to the U.S. last week to testify about the diesel emission scandal. Representatives from the FBI and Justice Department were present, as was Larry Thompson, the U.S. monitor appointed last year to oversee reforms at the company. Unfortunately, Bild doesn't mention any sources. Reuters did some investigating and got conflicting stories. One source told the news service that Diess and Thompson recently traveled to the U.S. recently with "relevant authorities", without going into further detail. Another source denied that a meeting took place last week, saying Diess met with spoke with authorities a few months ago. Volkswagen declined to comment.   9. We all know someone who takes things a bit a too far. In the case of automakers, that someone is EPA Administrator Scott Pruitt. Back in April April, Pruitt announced a serious rollback of fuel economy regulations that were set in stone during the Obama administration. In a summary of the proposed draft, the EPA would rollback the fleetwide average from 46.8 mpg for the 2026 model year to around 37 mpg - the fleetwide average for the 2020 model year. The draft also mentions pre-empting "California's authority" on setting their own emission standards under the 1975 Energy Policy and Conservation Act. This move has caused California and a collation of other states to file suit over the proposed changes. According to Automotive News, the changes proposed by Pruitt go a bit too far for automakers. All they wanted was the emission targets for the 2022-2025 model years to "ratchet up more gradually and offer more compliance flexibility." Now, they have to worry about litigation and uncertainty. "I don't think anybody in industry, when asked for reopening of standards, asked to level out to zero," said an unnamed lobbyist for a major automaker. However, certain groups argue that automakers should have expected something far-reaching under this current administration. "You've got to know your audience. If you go to [EPA Administrator] Scott Pruitt and Donald Trump and say you want relief from the rules and they are going to cost jobs, this is what you end up with," said Andrew Linhardt, deputy director of the Sierra Club's clean energy campaign. Later this week, executives from the major automakers will be meeting with officials at the White House to see if they can get the federal government and California to agree to some sort of comprise.   11. Last week, we brought you news that Bentley is planning to catch up on the electrification trend that a number of other automakers are ahead on. We now have some possible details as to some of their plans. The next-generation Flying Spur, due out towards the end of the year could be the second Bentley model to be offered with a hybrid powertrain. "Obviously Bentayga is our highest volume car so that’s the first one we have to hybridise. The next volume car is probably going to be the saloon car, so if you wanted a second car just for compliance, then that would normally be the next selection," said Bentley CEO Adrian Hallmark to Autocar. Hallmark said "possibly" when asked if said sedan could be the Flying Spur. He said a decision would come in the next six months. Then there is the successor to the Mulsanne. Autocar has learned that Bentley is debating whether or not they will do "a like-for-like replacement" to the current Mulsanne or something else. One possibility is to make the replacement a pure electric vehicle as a forward-looking flagship model. But during that same time, Volkswagen's current CEO got a rare safe-passage deal from the U.S. Bloomberg has learned from a couple of sources that the Justice Department has given Herbert Diess a safe-passage deal - basically allows him to travel without the worry of being arrested in connection to the diesel emission scandal. Diess also got a spoken assurance that he would be notified if prosecutors seek to charge him in the diesel emission mess. Being the CEO of a major automaker, Diess needs to travel to various events around the world. By giving him this deal, Diess will be able to travel without the fear of being detained. According to former prosecutors and criminal defense lawyers, the safe-passage deal for Diess is very unusual. They could only think of two reasons as to why Diess was given this deal - U.S. doesn't believe it will charge Diess or he is proving key information into the investigation.   15. Back at the Consumer Electronics Show in January, Kia rolled out the Niro EV concept. Aside from the wild design cues, the Niro EV concept featured a 150 kW (201 horsepower) electric motor and 64 kWh battery pack. Range was estimated at 231 miles. Just a couple of days ago, Kia revealed the production version of the Niro EV. Unsurprisingly, the electric version doesn't look significantly different from the hybrid/plug-in hybrid Niros. The only changes are a closed-off, body-colored grille with a door for charging port; faux grilles on the front and rear bumpers, and LED foglights. The Niro EV features Kia's new electric powertrain that includes an electric motor with a 64 kWh lithium-polymer battery pack. Overall range is estimated at 450 kilometers (about 280 miles) on the World Harmonised Light Vehicle Test Procedure (WLTP). Expect the EPA estimate to be slightly lower. There will also be 39.2 kWh battery available that is said to offer a range of more than 300 kilometers. We expect to have more details on the Niro EV such as power ratings and a release timeframe when the Niro EV debuts at the Paris Motor Show in September.   17. When Chevrolet unveiled the Suburban and Tahoe RST last year, the Suburban seemed to get the short end of the stick. It didn't have the option of the 6.2L V8 that was available on the Tahoe. Chevrolet is fixing that for the 2019 Suburban RST. Available later this summer, the RST Performance Package for the Suburban brings the 420 horsepower 6.2 V8, 10-speed automatic, and magnetic ride control. We don't have a 0-60 mph time for the Suburban, but we're expecting to be a few tenths slower than the Tahoe RST with the same powertrain. Chevrolet does say the Suburban RST with the 6.2 can tow up to 8,100 pounds. “The RST Performance Package made its debut on the Tahoe RST last spring, and the response from our customers was overwhelmingly positive. In fact, Tahoe RST with the Performance Package is the fastest-turning Tahoe model, and we’ve received customer requests to offer the same performance and power to Suburban RST. The engine delivers three state-of-the-art technologies — direct injection, Active Fuel Management and continuously variable valve timing — to make the most of power, torque and efficiency across a broad range of operating conditions. Suburban RST will also feature a new 10-speed automatic transmission. Smaller steps between each ratio maximize engine power under acceleration. With a wide 7.39 overall gear ratio spread and lower numerical top gear ratio, the transmission also reduces engine revolutions at highway speeds. Magnetic Ride Control is an active suspension that “reads” the road every millisecond, triggering damping changes in the electronically controlled shock absorbers in as few as 5 milliseconds. As a result, the suspension delivers both improved body-motion control during cornering and a more comfortable ride while cruising.   18. When Chevrolet unveiled the Suburban and Tahoe RST last year, the Suburban seemed to get the short end of the stick. It didn't have the option of the 6.2L V8 that was available on the Tahoe. Chevrolet is fixing that for the 2019 Suburban RST. Available later this summer, the RST Performance Package for the Suburban brings the 420 horsepower 6.2 V8, 10-speed automatic, and magnetic ride control. We don't have a 0-60 mph time for the Suburban, but we're expecting to be a few tenths slower than the Tahoe RST with the same powertrain. The indictment, which was filed under seal at the U.S. District Court in Detroit back in March, was unsealed yesterday. U.S. Attorney Matthew Schneider said in court filings the reason for unsealing is "because there is no longer a belief that unsealing these documents will compromise an ongoing investigation." Winterkorn has been charged with four felony counts, including wire fraud and violating the clean air act. In the indictment, it is alleged that Winterkorn was told about the efforts to manipulate U.S. emission tests with their TDI vehicles in May 2014 and July 2015. Winterkorn has previously stated that he only found out about the cheating in August 2015. The indictment also mentions a meeting that took place on July 27, 2015 at Volkswagen's Wolfsburg headquarters. It is reported that a Powerpoint presentation was shown to various executives, including Winterkorn, that laid out the process of deception that Volkswagen was doing to regulators. Allegedly at the meeting, Volkswagen employees recommended that the company work on getting the approval of 2016 model year diesel vehicles without revealing the existence of the cheat software. Various executives including Winterkorn agreed to the plan. "If you try to deceive the United States, then you will pay a heavy price," said U.S. Attorney General Jeff Sessions in a statement.   21. The past month has been quite strenuous on the relationship between the Environmental Protection Agency and the State of California. Back in April, EPA chief Scott Pruitt announced they would be rolling back the fuel-efficiency regulations set towards the end of President Obama's tenure. The EPA also announced that it was considering revoking California's waiver to set their own emission standards. A few days later, we reported that the officials from the White House, California, and automakers were trying to work out a possible emissions deal to prevent a legal fight. It seems those talks went nowhere as California along with sixteen other states and the District of Columbia have filed suit challenging the rollback. On Tuesday, the collation led by California filed a suit in the U.S. Court of Appeals for the District of Columbia challenging the rollback. This group makes up 40 percent of the U.S. auto market. "The states joining today's lawsuit represent 140 million people who simply want cleaner and more efficient cars. This phalanx of states will defend the nation's clean car standards to boost gas mileage and curb toxic air pollution," said California Governor Jerry Brown in a statement. The suit alleges that the EPA decision to roll back the regulation lacked any scientific reason. The EPA is also accused of failing to follow its own regulations and violating the Clean Air Act. “This is California saying: You really want war? We’ll give you war. It’s a signal to the administration that they’re not going to get away with anything in this space,” said Dan Becker, director of the Safe Climate Campaign to the New York Times. According to Reuters, the Department of Transportation has a draft proposal of the changes that is expected to be released to the public later this month. The draft would freeze emission requirements for vehicles at 2020 levels through 2026. The draft also asserts that the Energy Policy and Conservation Act of 1975 bars California from imposing their own rules, even with the waiver. This proposal has already earned the ire of the public and various members of the U.S. Senate. One Senator, Tom Carper, D-Delaware obtained a copy of the proposal and sent a scathing letter to Transportation Secretary Elaine L. Chao and Pruitt. “Such a proposal, if finalized, would harm U.S. national and economic security, undermine efforts to combat global warming pollution, create regulatory and manufacturing uncertainty for the automobile industry and unnecessary litigation, increase the amount of gasoline consumers would have to buy, and runs counter to statements that both of you have made to Members of Congress,” wrote Carper. There is a lot riding on this suit as it could possibly cause the U.S. to have two different emission regulations and automakers having to meet both of them. "Enough is enough. We're not looking to pick a fight with the Trump administration, but when the stakes are this high for our families' health and our economic prosperity, we have a responsibility to do what is necessary to defend them," said Xavier Becerra, California state attorney general. Yesterday, the White House announced that it will be meeting with leaders of the major automakers next week. The meeting will be talking about the planned changes to the fuel efficiency rules.
